Federal regulations now require that lenders and providers of real estate settlement services protect customer’s personal information and adopt practices that ensure proper and compliant handling of lenders’ and clients’ transactions and funds. In response to this development, The American Land Title Association (ALTA) has created the Best Practices framework to assist lenders and other real estate professionals in satisfying their responsibility to ensure that the settlement agents which handle their clients’ transactions provide a safe, secure, positive and compliant real estate settlement experience.

Only a handful of title companies have received independent, third-party certification. There are many companies who claim to be “certified” in ALTA’s Best Practices, but most of those certifications are either self-proclaimed or provided by third parties that lack the credentials of an established compliance audit firm.
